Once you are ready to send in your electrical and electronic device(s) (“Device”) for recycling to Re-Teck Envirotech Private Limited (“we” or “us”), follow these simple steps to expedite the shipping process and help Cloudtail India Private Limited (“Cloudtail”) in making a positive impact on our environment:

• Remove or delete all personal data from your Device.

• Use sturdy corrugated cardboard boxes. We encourage the use of recycled boxes. Please make sure that the box is in good condition to ship your Device.

• Wrap fragile materials individually so they do not touch each other.

• You may ship up to 25 Kgs per box for recycling to us.

• Make sure that the box is properly sealed so that your shipment is received by us in a proper condition.

• Remove old address/shipping labels from the outside of the box, to avoid confusion.

• Clearly write in big text “RETECK RECYCLING (CLOUDTAIL)” on the outside of the box.

• For recycling of IT Devices, our carrier will collect the box on the date provided in their email, which will be sent to you upon submission of an online form on this website. Please ensure that you are available at the time of collection of shipment. If you or your package is not available on the schedule date, time and place, the carrier will notify you and attempt the pickup on next day. If you or your package is not available on such second day, your request will be cancelled and you may have to schedule a new pick-up date by submitting the online form to us.

• While it is our responsibility to pick up and channelize the e-waste arising out of Device in an environmentally sound manner, it is your responsibility to provide your own box and packing material for shipment of your Device.

IMPORTANT INFORMATION BY CLOUDTAIL INDIA

Cloudtail recognises the importance of recycling electronic equipment at the end of its useful life, which is why we offer a recycling program for electronic items that have been legally purchased from us. Currently, the process for recycling end-of-life devices and equipment purchased from Cloudtail is through shipping your Device to our certified recycler. Cloudtail has authorized Re-Teck for collection of e-waste from consumers and for further disposal of such e-waste as per the E-Waste Management Rules, 2016 as notified by the Central Government. All devices and batteries sent for recycling will undergo material reclamation by a licensed recycling facility. All identifying marks or personal documents will be erased or destroyed before or during the recycling process.

In view of the above, please be informed that the Reteck Recycling Portal available http://reteck.co/recycling (“Website”) is merely a re-commerce platform established by Re-teck to allow customers to send in their electrical and electronic device as purchased from Cloudtail for recycling in compliance with the E-Waste Management Rules, 2016.

You agree, understand and acknowledge that Cloudtail is only a facilitator and is not and cannot be a party to or control in any manner any transactions on the Website. Accordingly, the contract of provision of pick up and recycling services on the Website is a strictly bipartite contract between you and Reteck. We shall neither be liable nor responsible for any actions or inactions of Reteck nor any breach of conditions by Reteck, and we hereby expressly disclaim and any all responsibility and liability in that regard. We shall not mediate or resolve any dispute or disagreement between you and Reteck in relation to the services or use of this Website. You hereby expressly release us and/or our affiliates and/or any of our officers and representatives from any cost, damage, liability or other consequence of any of the actions/inactions of Reteck and specifically waive any claims or demands that you may have in this behalf under any statute, contract or otherwise.

1. Scope of Services

The computer hardware and mobile devices recycling service (“Services”) is provided by us on behalf of Cloudtail for its consumers to recycle electrical and electronic equipment, including but not limited to mobile devices, television, CPUs, monitors, printers and peripherals (“Devices”).

2. Customer Responsibilities

You must pack and ship the Devices in accordance with our instructions (as stated above), including but not limited to, instructions regarding weight limitations, quantity and types of items to be recycled. You must make the Devices available for pickup by the carrier identified by us. Once the Devices have been picked-up, the same will not be returned to you. You will ensure that your shipment contains only such Devices which are mentioned in these terms and conditions and that such Devices match the products specified by you at the time of filling the online form on this website or opting for this Service.

3. Notice regarding Customer Data:

You are responsible for removing all confidential data or data subject to applicable data protection laws, from your Devices. In particular, before you ship the Devices for recycling, you are responsible for: (a) deleting the data on the hard disk drives and any other external storage in the Devices such as mobile memories; (b) backing up or transferring any data prior to deletion; and (c) removing any removable media, such as mobile cards, diskettes, CDs or PC Cards. We and / or Cloudtail do not accept liability for lost or confidential data or any software.

4. No Contaminated Products

This Service is not intended for Devices that are or have become contaminated or suspected of being contaminated with chemicals, biological agents or other substances that are not integral to the original new equipment or otherwise associated with normal office or household environments. Products that may be contaminated must be decontaminated prior to shipment by you.

5. Non Compliance

If you fail to comply with the terms and conditions of this Contract, then we are not obligated to provide the Service to you. In addition, the carrier or the postal office may refuse collection or return the Devices to you and you may incur additional fees.

6. Cancellation Policy

7. Warranty

RETECK WARRANTS THAT IT WILL PERFORM THE SERVICE WITH COMMERCIALLY REASONABLE CARE. RETECK MAKES NO OTHER WARRANTY AND DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. YOUR STATUTORY CONSUMER RIGHTS ARE UNAFFECTED BY THE ABOVE LIMITATIONS.

8. Limitation of Liability

RETECK DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH HEREIN. RETECK WILL NOT BE LIABLE FOR LOST PROFITS, LOSS OF BUSINESS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY. YOU AGREE THAT RETECK IS NOT LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE AGGREGATE AMOUNT PAID BY YOU FOR THE PURCHASE OF SERVICES UNDER THIS AGREEMENT OR LIMITATION AMOUNT SPECIFIED IN RETECK'S STANDARD TERMS AND CONDITIONS OF SALE AND SERVICE, WHICHEVER IS THE LESSER

9. Applicable Law, Jurisdiction, Compliance.

You and Reteck agree that all matters arising from or relating to the use and operation of the Website and/or the Services will be governed by the laws of India, without regard to conflicts of laws principles and the courts at New Delhi shall have exclusive jurisdiction to resolve any disputes in relation thereto.

10. Miscellaneous Provisions.

No delay or omission by us in exercising any of our rights occurring upon any noncompliance or default by you with respect to any of these terms and conditions will impair any such right or be construed to be a waiver thereof, and a waiver by us of any of the covenants, conditions or agreements to be performed by you will not be construed to be a waiver of any succeeding breach thereof or of any other covenant, condition or agreement hereof contained. Neither party will be liable for its failure to fulfil any obligation under these terms and conditions due to causes beyond its reasonable control.
